CHRIS DAY - ANOTHER ATTACK AGAINST ME

CHRIS DAY: " I have filed a second preferring of charges and this time I sent a copy by certified mail to our Union office and the member being charged. I wrote the Union office name and address as the return address on the letter sent to the member. The member refused the letter because it was not on official ATU757 letter stock and accused me of harassment." 

ME:  Had I refused the certified letter Mr. Day sent I wouldn't have known what was in it.  The post office has a record that shows when the mail was delivered and signed.  Day also received the signed receipt. Where does it say I refused the mail?  Day wrote ATU as the return address because he didn't want me to know who it was really from.  Way too secretive for someone who proclaims TRANSPARENCY.

CHRIS DAY:  "I have been sending international copies of all the communications that has been going on. I found myself getting disappointed because I was not getting any responses from them."

ME:  Whose he gonna report International to?  Time and time again Day validates my claims.  If ya don't do it his way and his way only, he reports ya.  With me he went to HR, Peggy Hanson, Hayden Talbot and others.  Whose he gonna report Hanley to, Obama?  

CHRIS DAY:  "President Hunt had denied me my Union Constitutional right to present this to the membership and He sent a copy of the charges and the list of names and signatures to the member being charged. The member being charged then filed an HR complaint and released the list of names and signatures to HR. Both the member being charged and HR made contact with members from that list. The member being charged stated “After being called up to HR, I'm willing to bet most of those people were embarrassed at having to go through that process.” A total of fourteen (14) members signed the signature list."

ME:  I filed a complaint through HR  but NOT for Day's Preferring of Charges complaint because he has a right to do it, but because of the methods he used in obtaining signatures.  Blatantly, right in front of me in my workplace (bullpen) he went from person to person, from table to table.  Workplace is off limits per HR-171.  Respectful Workplace.  Additionally, Day trolls my blog and misinterprets my words.  I was expressing MY VOICE regarding these incidents.  According to the letter of finding I received from HR the only people she interviewed was Chris Day and one signer.  And she may not have even contacted the signer since she has a history of not following through with the complaint process.

Always blaming.  Now he accuses Hunt of denying him his Constitutional rights.  Day sent me 3 (three) pages out of 7 (seven) because he doesn't want me to be able to defend myself. You can't charge someone with something and not tell them what it is.  This is becoming more and more bizarre!!!

ME:  He accuses me of making contact with the signers.   I contacted one - screen shots below:  A friend contacted one of 'em and one of the signers contacted me , apologizing, said he felt "ashamed for not reading what he signed."  Both said they were told the petition was for the Union.  There was no paperwork for them to read.

But, the truth is,  there's no law preventing me from contacting all of the signers on a petition.  I could if I wanted to but I respect everyones right to choose even if it's for something that could potentially cause me to loose Union Representation. (I'll still have to pay the dues, though)  If someone doesn't want to stand behind their signature then they ought not sign it.  

CHRIS:  "I currently asked Peggy to reply about the accusations that Ellen has made and here is her reply “I recall that our shared objective was to resolve or end a series of troubling rhetoric or email exchanges occurring between you and your colleague. The challenge was that while the activity was occurring outside of the work environment, not surprisingly, it led to affecting you both within your workplace.

At no time did you or your colleague report other employees to me. That simply would have been inappropriate."

ME:  All I can say about it is for someone to get up at the next Union meeting and simply say nothing more than three words:  PEGGY HANSON (pause for a second, and then say)  CREDIBILITY and that should take up the better part of the day so ya all better come early and bring food 'cause it's gonna be a looong but entertaining afternoon.  

What's different with this situation with Peggy is that she told the same story about Mr. Day on two different days to three 

different people.  So I believe it.      

CYBERSTALKER - JEFF WELCH

CYBER ABUSE IS MORE DANGEROUS FOR THE VICTIM AS IT'S A MEANS TO CONNECT WITH OTHER ABUSERS :

Based on Welch's Freedom of  Speech Behavior, he's probably one of those guys who goes home,  kicks the dog, beats the kids and the wife. He refers to women as Bitch, (above screen shot) Cunts and Whores.

Mostly, Cyber Bully/Stalkers WANT And NEED their activities publicized.  That way they can find online friends who share their abuses and can validate and feed off each other.  Kinda like 'boys night out' except they're grown men mostly with mortgages, kids,  a wife or two on the side, a lawn to mow and a responsible career.  

Cyber abuse is all about personal gratification. They hide behind a monitor but no longer care who's watching. There's no boundaries. Their victims could range from very young children to the elderly.  Their minds convince themselves that as long as they're hidden behind their monitor - in the privacy of their domain they aren't culpable. 

Abusers who act out emotionally or violently in their homes go to great extremes to protect their identity.  And, although perpetrators of domestic violence and perpetrators of online abuse are similar, the online abuser can be far more dangerous.  Once the abuser is exposed they can literally snap.  Not by destroying their precious monitor but by leaving the domain and acting out on their victims.  These are people who don't believe they've done anything wrong. They themselves feel victimized by their victims.  In my case, Rantings spent nearly two years creating a false persona of me in the mind of his viewers.  Constant rantings created to brainwash his viewers perception of another person without evidence.  Constantly referring to me as one with mental problems and other deficiencies  because he feared the truth about himself coming out - as it has.  The abuser, on and off line discredit their victims to protect themselves.  

Most of the screen shots and postings on this blog depict the abuses I've experienced from Rantings. But, he has now incorporated with two more who share his interest in people bashing.  One who decided to act out on his behavior in our workplace and the other a a blogger (Jeff Welch) from Peugeot Sound, Washington who calls me a 'bitch' and other choice names through screen shots and e-mail.  

One of the blogger's behavior is similar to the 'talk show' groupies. A bunch of viewers without an identity who latch on to someone else's and claim it as their own.  These are the ones who end up hanging out in Mall parking lots or McDonald's looking for someone to assassinate.  

Welch, on the other hand appears to keep his abuses to a minimun at least publicly. He's sends me threats through e-mail and as the above screen shot shows he quietly comments on other bloggers postings.  He uses profanity.  I don't know this guy from adam but that's the scary part. You get people together like that who don't know how not to HATE and you wonder how many other lives they've infected?!

From his blog, "Having a prior career in nonprofit organizations (many of which contracted with King County to provide services to people with disabilities) I have always had a positive view of King County  Government’s commitment to families."

So, he wants everyone to 'think' he cares about people with disabilities and he's a family kind of guy but then you realize what he secretly writes is who he really is.  

So, I write about Welch, Rantings and Day because their viewers need to understand they aren't quite what they seem.  I want others who've been violated by these three as well as countless others throughout the internet world to know they're not alone and here in Oregon we're getting increasingly closer to prosecuting these criminals.  

The last several screen shots on this blog were taken from Welch's blog.  His and another viewers comments validate everything I've been saying about Rantings for the last nearly two years.  When Welch realized I posted those comments he became quite enraged.  It later became clear, he didn't want his comments seen by others as he was 'cyber stalking Rantings.  He later posted, after the two actually met that Rantings was a, "decent guy".  I suspect the two recognized their commonalities over their differences and decided to feed off each other as Rantings did with Day and Alexander.  Kind of like ameba's  - each creating off shoots of their own.

Talking about cyberstalking, Al Gore said, "Make no mistake. This kind of harassment can be as frightening and as real as being followed and watched in your neighborhood or in your home."
That was in 1999, when Gore was vice president. In retrospect, this era was practically the Stone Age when it comes to the Internet: No Facebook, no MySpace, no texting, no tweets, no Blackberry phones. Heck, people thought instant messaging was cool back then. Now? IMing is the equivalent of the eight-track tape.

JUST BECAUSE SOMETHING'S LEGAL DOESN'T MAKE IT MORAL

One of the challenges I've had throughout this horrifically long battle with an ex-old friend   Cyber Bully/Stalker  is a question that keeps going through my mind, "How can you do this?  I mean morally?  OK, so it's legal to tape record someone over the phone without telling them, but why would anyone want to?  And then the question arises about the legality of publishing a secretly recorded phone conversation or video over the internet.  It's illegal, an invasion of privacy.  My lawyer informed him of the law. But still, he continues doing these types of things to others.  It has to do with what's right and what's wrong and how we treat each other in this World. Screw the legal issue - what type of a creature does this crap - to anyone? wtf

He literally destroyed my trust and then had the audacity to question why I didn't want to be his friend anymore.  "But what about our friendship?" That would be like Linda Tripp  asking Monica Lewinsky to be her friend again.  "Hey, chick - give me a call sometime." Does  this individual not have the ability to comprehend that what he did was a really, really 'BAD' thing?  Does he not get the 'bigger picture' of how his behavior affects others? Does he not have the mental capacity to understand that this is not MORAL - even if it's legal. Why would someone want to purposely hurt another person?  There's been a lot of dialogue about this question regarding his behavior.  Some say he's narcissist - totally self-absorbed.  Some say it's because he's insecure - needs lots of attention. Some say, as the Judge in New York did that he thinks of himself as important and famous.  I say it's because he doesn't have a conscience. Whatever it is I wouldn't want to be within a hundred miles of him when karma hits.

This guy's history with me documents back to a series of internet abuses starting in early July, 2009.  At first I looked at it as a learning experience - something that happened, but it (or I thought it was) soon resolved after I requested he remove/delete the secret tape recording and he subsequently acknowledged that he had.   As far as I was concerned it was all done and over with in a matter of days but apparently not so on his end.  Like most abusers, he was angry that I no longer wanted a friendship with him so he went about a nearly two year (still going on) very publicly abusive tirade against me  Admonishing me publicly. As time went on he kept the 'deleted' recording and used it at times in whole without voice distortion and at times in small clips to try to control my behavior.  Over the years, he systematically created a negative and hostile image of me over his blog.  Always speaking in the third person as though his rants were a compilation of how "everybody" who works at TM feels. He elected himself as the Operators spokesperson and representative (unannounced to us) and as such created over 32 negative, highly inflammatory, slanderous You Tubes plus numerous written entry postings on his other Blogs about my character.  He purposely created them to publicly denigrate, control, intimidate and create a false image of my character in the minds of my co-workers, managers and whoever else views (2,000 plus hits a week) his site.  He wanted his viewers to think I have mental problems and can't differentiate between what's real and what's not. Typical abusive behavior only it was done over the internet.  So now I've got people coming on my bus recognizing me, with preconceived ideas about who I am.  And, I've got another wanna be Rantings guy, Chris Day, co-worker and big fan and blogging partner of the other one who  presented a petition to our Union to have me blackballed so he can get votes when he runs for Union President. Someone needs to sit him down and explain what Unions are.  What they aren't is about exclusion because you have a problem with someone.  What the hell's going on here?  Is it in the drinking water or what?  Oh, and Lordy, Lordy -  don't let me forget this part:  Ellen Fox Blog Watch

As I've aged I've learned a few things. Here's two of 'em:

1.)  Careful about your expectations of others.

2.)  Careful about who you give your power to.

I experienced something most people hopefully will never have to in their lifetime.  He presented himself as kind, fun and smart.  But what I didn't realize until this very public spectacle is that his persona was faked. He assumed a personality that was literally beyond compare to the real person.  Yet, another characteristic of an abusive personality.

He initially played the recording with a slight to medium voice distortion.  You could make out what I was saying without a problem.  Regardless of what he says, my voice was recognizable so that throws out the "But I protected you" theory. He wrote in his e-mails plus told both Judges: "Your voice was distorted", "I thought you wanted to be heard so I went ahead and distorted the whole thing and put it up!",  "I hid your identity, there is no possible way for anybody to know who I was talking to, it's not possible, I changed the pitch and the speed of the audio." BUT through the same series of e-mails he admits that he wanted "Trimet employees and the world needed to hear that!" "I wanted Trimet  to hear that too!" Further down there's another e-mail that says, "the feedback I got on the video was INCREDIBLE! VERY FEW PEOPLE KNEW ANY OF THIS." Talk about talking out of both sides of your mouth.  I didn't care about what I said as much as I cared about the betrayal (by someone who called me a friend) of being recorded and published without my knowledge. And then he says, "I'm sorry, I'm sorry, I'm sorry BUT IT'S LEGAL and sends me a copy of the Oregon State Statutes.

There's been numerous instances of a-moral behavior.  Too many to list:

He was 86th from 24 Hour Fitness for secretly filming in the men's room.

He secretly video/audio taped and published several co-workers and managers.

He was caught on his own blog filming women's restrooms at various Transit Centers.

He was caught on his own blog filming and publishing himself using restrooms.

He was caught blogging and operating a bus via his own blog.

He was caught audio/video taping on the MAX in uniform but off duty.  That equates to the cable guy knocking on your door in uniform but off duty.

He secretly audio/video taped co-workers venting about bicyclists. They said such things as 'wanting to run over a group of 'em'. He then posted the video on bikeportland.org, along with another video where he filmed himself literally shoving large amounts of food in to his mouth while chewing and talking.  Food particles spitting every which way as he talked.  And then later that same evening filmed himself naked while sitting on the toilet having another discussion with bikeportland.

He started playing dispatch tapes along with making personal comments regarding co-workers who were asking for assistance under sometimes difficult conditions.  Operators were becoming leery of calling for help - not wanting to be recognized or commented about on his Blog.

Who are These People and Why is Trimet Secretly Filming Them?

The headings of his blog postings are negative and slanderous. The blog is largely negative and abusive in content.  He resorts to name calling. He uses it to publicly chastise and abuse people he doesn't like or understand.

The bottom line remains in his mind.  It's legal so fuck anyone who doesn't like it.

Internet bullies and stalkers hide behind Freedom of Speech,  Vancouver Blotter - Trimet Faces Social Media, Free Speech Challenge  It's not their Freedom of Speech that's the threat but behavior and the consequences that behavior creates.   Oregon enacted laws against abuses over the internet but they're not currently enforcing them, YET.  It's my hope, through this blog and continued conversations with State Representatives and others that the laws put on the books to protect citizens from this crap will start being enforced.  It's my hope that those who tread on the lives of others so criminally and unjustifiably find themselves locked away from society.

The series of e-mail below document our final conversation after I discovered he taped recorded and published me on his Blog nearly two years ago without my knowledge or consent.  It's time to re-publish. They are revealing as to character - the character of an abuser - the character of someone who uses his computer and hides behind Freedom of Speech to abuse and harass.  Click the images to enlarge. When Bloggers Defame

The Internet has been hailed as the new frontier of liberty, a bastion of free speech where everyone is given a voice and a podium from which to speak their mind.

The Web log or “Blog” has followed in the steps of chat rooms and discussion groups, emerging as the most popular form of on-line public expression. Across the country media are quoting bloggers as “experts,” trumpeting them as 21st century Paul Reveres who cover the stories the mainstream don’t have time for or interest in.Before going further, I acknowledge there are thousands of credible, honest, intelligent and articulate people who write journals on the Internet. And then there are the kooks. For instances, take an hour or two this week and take a superficial journal through the world of political blogs. With a few exceptions like Jim Shella of WISH-TV, blogs in this vein tend to be horridly partisan, self-serving, poorly-researched, and tremendously one-sided. 

Rarely do these “reporters,” “authors,” or “experts” take the time to name sources (if they have any), conduct any quantifiable research or offer a balanced perspective on issues. They quote unnamed “sources” as often as Paris Hilton changes boyfriends. This is not to say one shouldn’t read them, just do so with both eyes open so to speak.

Consider yourself fortunate if have never been targeted by an irresponsible blogger. Essentially, he or she states opinions as fact and invites others to do the same. Pretty soon you have the digital version of a boys’ restroom wall for the world to see. Mainstream journalists are turned on to these sites and, before you know it, you’re receiving strange calls from all kinds of people asking you about the claims, allegations and rumors being perpetrated by the blogger.

So where do you turn when a blogger starts blasting away? Here’s the first thing you should know: Bloggers are not immune from a little charge known as defamation. To defame means to attack or injure the reputation or honor of by some false and malicious statements. Bloggers will often defend themselves by reflexively stating they have a right to express their opinion; however, this is not an absolute defense.

According to local attorney Daniel Byron, one of the state’s leading experts on libel, defamation, and slander, “It is important to note that opinion-type statements are outside the law of defamation. In other words, if a blogger gives his opinion as opposed to a misstatement of fact, then no suit for defamation could be pursued. Keep in mind, however, that the Supreme Court of the United States has forcefully stated that a false statement which mixes opinions and facts can be defamatory. Also, conclusions of fact stated by a blogger are still defamatory and not considered opinion.”

Mr. Byron’s last statement is critical regarding conclusions of fact. This is precisely the practice in which so many bloggers engage. Without the benefit of a journalism education or law background, they concoct a stew of half-truths, personal opinion, rumors, innuendo and wrap it in a cloth of self-righteousness to vilify those against whom they have a personal agenda. The blog becomes more a means to pursue vendetta than a platform for free speech. And when that happens, individuals, the companies for which they work, and the organizations for which they volunteer are at risk.

In order to prove defamation, “The company or individual would need to show that the blogger has made a false statement of fact which injures reputation, that he has published this blog to numerous third parties, and that the blogger was at least negligent in not learning the truth regarding the article. Normally, if a false statement of fact was made, negligence will ordinarily follow and the harm to the business or individual would be obvious. Assuming a false statement of fact, it then follows that the recovery for damages could be pursued,” Byron says.

I encourage you to begin exploring the so-called blogosphere as soon as possible. What’s out there may shock you. If you do find reason for concern, the first person to call is your lawyer.Secondly, Mr. Byron offers this course of action: “If a blogger is using a particular server to give his defamatory statements, the proper remedy is for the company to notify the server by certified mail of the defamatory nature of the blogger’s comments and then request that the server cease and desist permitting such blogging to continue through its server. If the server refuses to do so, or suggests that it has a disclaimer which protects it, then the server can likely also be sued,” Byron says.

In matters of reputation and honor, much is at stake. This is especially true in the age of instant disinformation. Always know your options.
