Because Trimet via Peggy Callahan lied about all of it to the Government Investigator, I'm exposing it here as information for public transparency.

This posting, the third in a series of more, is about two complaints filed against me by Al Margulies and an additional one from John Olsen, as they had done before and continue to do again and again and again..... filing charges against me to Trimet's HR Department, but THESE complaints in particular are from October of 2011 and generated four reprimands. Not the first time I've received reprimands from Olsen but the Union grievance process was able to get them thrown out since HR didn't conduct an actual investigation.  I am currently waiting a step III on this last group.  

This posting is also about the meeting which generated the 4 reprimands and how I was treated. It was required by Senior Human Resources Representative Peggy Callahan in which SHE SEVERELY MISTREATED, BULLIED AND INTIMIDATED ME! Her mission was to CAUSE EXTREME EMOTIONAL ANGUISH AND THEN SHE EXPECTED ME TO OPERATE A 40,000 LB or 20 TON BUS ON THE STREETS OF PORTLAND!  



At the start of the meeting she disclosed she was, "under orders". I pursed it, she admitted it.  Doesn't matter. "NO" is still a complete sentence IF you possess the integrity to say it!  She could have refused and then conducted the meeting professionally but unfortunately it didn't happen.

I was accompanied by my Union Representative.  Many of you know her, you know her reputation. If at any point you question anything I've written here, please feel free to ask her for verification.  You know she doesn't take anything out of meetings or discuss members with members or with anyone else. But because of the nature and experience we shared with Peggy that day, combined with what Peggy told the BOLI Investigator in the highlighted document above, I expect she would be more then willing to relate that the experience as I have articulated it here is indeed FACTUAL!!!  

Callahan called me to the meeting and made three accusations. Two from Al Margulies and the other from John Olsen. Other then Olsen's, she refused to relate Margulies' claims against me.  She ordered me to remove an image from my blog but refused to say which image and where I might find it. (see image below) She threatened me with suspension and or termination. Each time I asked which one she was referring to she yelled out similar to a parrot in a high pitched shriek, "Now Ellen, now you know better then that, now Ellen, now Ellen..."  At one point she shoved a stack of papers (copies of my Blog) across the table over to me and there they sat.  I was not allowed to ask questions!  At one point I was so frustrated by the continuum of abuse I was in tears. I leaned in and looked right at her and said, "I AM IN A DEEP __________!.  Do you know what that means?" As an HR Representative she knew what I had just relayed to her was my DISABILITY, recognized by the ADA and protected by BOLI. She didn't blink an eye, she said nothing - just glared - wide eyed and empty.  KNOWING full well what my disability was at that point, she EXPECTED me to OPERATE A BUS ON THE STREETS OF PORTLAND! I asked for special accommodations by asking that I be allowed to go home. I WAS NOT 'FIT' TO OPERATE A BUS! She continued to glare.  My Union Rep literally begged her not to put me in a bus.  She shrugged her shoulders!  'SO WHAT?!!!'  She advised us that she would call Evelyn Warren, Center Street Station Manager to see what she could do.  Evelyn told us she received the call from Peggy but there wasn't anything she could do either. Her concern she said was they may not have Operators to cover my run. Interesting because when I had the problem with Jensen she immediately gave me a tda (time off without timeloss). It trickles down - they HAVE TO take orders or they risk loosing their careers.   A Stations Agent later saw me in the bullpen and immediately gave me a tda. He said, "No way are you going out (driving) like that!"  Couldn't even ride my bike home.  So there I am out front waiting for a bus and feel something like someone's staring at me. I turned and saw Hayden Talbot staring at me with the BIGGEST (bigger then usual) SMILE you've ever seen.  His lip was partially curled up.  He stayed there staring /glaring at me saying nothing until the Bus came.  WorkPlace Bullying!

Because of the nature of our jobs there are no set rules about notifying Trimet of a disability unless the job affects you or the disability affects the job as was in my case. There are no set rules or policies  for employee disability issues. In 2002,Trimet was requiring ADA in writing from your Dr. in order to accomodate a request such as a certain Bus style. Because I'm short (5' 1") I asked for a certain style Bus because I came close to killing someone. With all the blind spots like high fare boxes, clamshell mirrors, the windshield and door pillars, etc. I couldn't see where I was going. Even rockin' and rollin' in the seats didn't correct the problem. The newer buses today (3000 series) are by far worse. Trimet used to send trainers to the Factory now the people in charge of ordering new buses and other safety sensitive equipment pick from a brochure. I had to see HR about it because Trimet considered being 'short' a disability. In reality is was a SAFETY issue but that meant it would cost them some money. It was cheaper to not take a proactive stance and just blame it on employees stature. I couldn't get a disability for being short because being short wasn't a disability so I was required to operate Buses on the streets with less then 50% visibility. Even if you had, say a shoulder problem which your Dr gave you a disability for, Trimet still wouldn't honor it with proper accommodations. They don't care! They  just  give you what they have.  What I ended up doing was asking dispatch for courtesy trades because It was a SAFETY issue for me! One Dispatcher asked if I was refusing to drive. 

The thing about Trimet is you want to be very careful about what personal information you share with them because many of the Managers aren't professional enough to protect or respect your privacy.  I had no reason to share my disability until they created a situation where it kicked in and as a result I literally became an ENDANGERMENT TO PUBLIC SAFETY.  

Not respecting my disability or the disabilities of my co-workers is not respecting the public!  My job is SAFETY SENSITIVE!  The safety of our citizens, our community is based on our / my ability to FOCUS.  IF I'M DOING MY JOB THE WAY I'M SUPPOSED TO, THE VERY NATURE OF IT IN AND OF ITSELF WILL FORCE ME TO FOCUS!  If something happens which CREATES A SAFETY DISTRACTION then that has to be dealt with professionally by the people who caused it. For example, Peggy Callahan has no business scheduling meetings with Operators or Maintenance because she doesn't understand what it is that we do for a living. She's not qualified or professional enough to recognize how her actions affect others! She needs to be educated but even more then that, Trimet needs to start hiring people who are not just bureaucrats but people who are qualified and have integrity!  People who are honest and fair and have a sense of humanity in their dealings with each other. Non-Union employees at Trimet have purposely separated themselves from the TRANSIT INDUSTRY as a whole. They are people who sit in cubiles and now that they're situated at Harrison Square they won't see the buses or the uniformed employees coming or going.  Above all, they have to remember they're WORKING FOR TRANSIT, THEY'RE WORKING FOR THE PUBLIC!!!

THESE complaints in particular are from October of 2011 and generated four reprimands. Not the first time I've received reprimands from Olsen but the Union grievance process was able to get them thrown out since HR didn't conduct an actual investigation.  I am currently waiting a step III on this last group.  

This posting is also about the meeting I was mandated to and how she conducted it. It generated 4 reprimands. CALLAHAN SEVERELY MISTREATED ME! SHE ACCUSED ME OF VIOLATING HR POLICIES BUT REFUSED TO GIVE ME INFORMATION. SHE ASKED IF I POSTED AN IMAGE OF AL ON MY BLOG AND WHEN I CONFIRMED THAT I HAD POSTED SEVERAL SHE INFORMED ME I WOULD BE TERMINATED IF I DIDN'T REMOVE 'ONE IN PARTICULAR.

I asked, "which one?" She responded, "NOW ELLEN, NOW ELLEN, NOW YOU KNOW BETTER THAN THAT, NOW ELLEN!!"  

I was blindsided. Not knowing what it was about I lost my ability to bring documents in my defense. The appointment was made smack in the middle of my sign-up, thanks to Evelyn Warren's assistance. They were out to get me from every angle possible.

There was much talk among some Union Officers that Peggy may have been hired specifically for her lack of conscience and her ability to stay disassociated from reality.  It was surreal. It was all very personal and retaliatory. You knew you weren't talking to someone who gave a shit how this encounter was going to affect you.

I was accompanied by my Union Representative.  Many of you know her, you know her reputation. If at any point you question anything I've written here, please feel free to ask her for verification.  You know she doesn't take anything out of meetings or discuss members with members or with anyone else. But because of the nature and experience we shared that day, combined with what Peggy told the BOLI Investigator in the highlighted document above, I expect she would be more then willing to relate everything as I've articulated it here as FACTUAL!!!

She didn't blink an eye, she said nothing - just glared - wide eyed and empty.  KNOWING full well what my disability was at that point, she EXPECTED me to OPERATE A BUS ON THE STREETS OF PORTLAND! I asked for special accommodations by asking that I be allowed to go home. I WAS NOT 'FIT' TO OPERATE A BUS! NOT FIT BY TRIMET'S STANDARD OPERATING PROCEDURES. She continued to glare.  My Union Rep literally begged her not to put me in a bus.  She shrugged her shoulders!  'SO WHAT?!!!'  She advised us that she would call Evelyn Warren to see what she could do.  

Evelyn told us she received the call but there wasn't anything she could do either. Her concern, she said, was they may not have Operators to cover my run. Interesting because when I had the problem with Jensen she immediately gave me a tda (time off without timeloss). It trickles down - they HAVE TO take orders or they risk loosing their careers. Not excusing her behavior just saying. Trimet is know to hire under qualified managers, pay them a large salary ($89,000 for Evelyn) with the expectation that they've bought someone, similar to themselves in that they'll take orders without question.  

A Stations Agent later saw me in the bullpen and immediately gave me a tda. He said, "No way are you going out (driving) like that!"  Couldn't even ride my bike home.  So there I am out front waiting for a bus and feel something like someone's staring at me. I turned and saw Hayden Talbot staring at me with the BIGGEST (bigger then usual) SMILE you've ever seen.  His lip was partially curled up.  He stayed there staring /glaring at me saying nothing until the Bus came.  So, with Hayden's entrance it told me how personal the attack against me was.  Talbot is a known born-again Christian who held prayer meetings in his office.  He did not like gays and he did not like Jews. I am both.  When no one was around and we'd pass each other, he had no problem letting me know his personal beliefs.

The thing about Trimet is you want to be very careful about what personal information you share with them because many of the Managers aren't professional enough to protect or respect your privacy.  I had no reason to share my disability until they created a situation where it kicked in and as a result I literally became an ENDANGERMENT TO PUBLIC SAFETY.  PTSD and Depression. Callahan treated me like I wasn't human, like I was nothing more than a piece of shit that no one cares about. 

 In my estimation, she's deeply disturbed. She gave me 4 reprimands without investigating. Wouldn't tell me what I did, threatened to terminate me.

In a Union - what happens to one, happens to all.  I grieved the reprimands. It took 3 years to hear them.  

When I finally had the opportunity to be heard - Jeffrey Ackerson, Executive Board Officer killed it.

October 19, 2011 Peggy Callahan, Trimet's Senior HR Investigator wrote the following e-mail to Executive Managers regarding the results of an (ALLEGED) investigation she claimed to have preformed.  The investigation was brought about by a harassment complaint filed against me by Al Margulies, Rantings blogger. My intention here is to show how Trimet operates with other governing agencies when a complaint is filed against them by an employee.  I have blocked out everything except the point I'm making.

A Union requested document exchange revealed HR Investigator Peggy Callahan, in an October 19, 2011 e-mail to Shelly Lomax, Director of Operations and Hayden Talbot, Director of Transportation that,

"Ms. Fox has since REMOVED THE PICTURE of Mr. Margulies from her website."

IN SPITE OF WHAT SHE TOLD THEM, SHE GAVE ME TWO REPRIMANDS! My Assistant Manager Leonard Lambert  was ORDERED TO SIGN HIS NAME to them but claimed he didn't know what they were about.  NONE OF US KNEW! NOT ME, NOT MY UNION REP, NOT LAMBERT! UNTIL, I received the exchange of documents.  

THEN, 7 months later, through a BOLI (BUREAU OF LABOR AND INDUSTRIES) public records search,CALLAHAN SENIOR ASSISTANT COUNCIL SHELLEY DEVINE TOLD THE Investigator,

"Complainant had also posted a picture of the employee without his consentand REFUSED TO REMOVE THE PICTURE off her blog."


GOT IT?!!

***update***  
Lesson learned: 

Federal law requires Public Agencies to legally protect or pay for their employees (including ex-employees) legal expenses should their work related actions or duties get them sued.  Probably explains why so many Public Employees (certainly at Trimet) act irresponsibly in their "POWER" positions because they know you and I are gonna have to foot the bill if they f*ck up! 

The exception being in cases like this the EMPLOYEE will $$$ pay up!  The Court system will make them personally ACCOUNTABLE. PEGGY CALLAHAN, LEONARD LAMBERT and ASSISTANT GENERAL COUNCIL SHELLEY DEVINE made themselves wide open for a personal injury law suit because they KNOWINGLY LIED in order to cause harm to another.   

I would HIGHLY RECOMMEND LAMBERT, CALLAHAN AND DEVINE NOT SIGN THEIR NAMES TO DOCUMENTS HE KNOWS ARE NOT TRUE! And that they NOT LIE TO GOVERNMENT AGENCIES investigating an employees claims of retaliation and discrimination.

LANE JENSEN, ALEX HAWK IMPERSONATING TRIMET OPERATORS

This one falls under the category of  STALKING, BULLYING and CYBER HARASSMENT.





Starting with Lane Jensen's video.
Notice Lane's complete LACK of composure.  He's VERBALLY ATTACKING a Trimet Supervisor.

Notice how the Supervisor walks away.

Good job, Supervisor!!!

Margulies continues to use a couple 'a bus groupies to do his dirty work.  Dirty work meaning REVENGE and GETTING ATTENTION,  at the cost of anyone or anything. 



So now there's two of 'em out there walking around in what Margulies calls their "Trimet Costume."








JUST BECAUSE SOMETHING'S LEGAL DOESN'T MAKE IT MORAL!


Supervisors have a right to question WHY NON-EMPLOYEES are riding the system walking around the Bus Mall and Transit Centers IMPERSONATING Bus Operators. SERIOUSLY, why are these guy's masquerading US?  Could it be they're scamming the system for free rides or PERHAPS they're  ATTENTION DEPRIVED?!!!

As STRANGE as it sounds, what's probably closer to the truth is they're on Margulies' payroll in someway,  like maybe he buys them pizza 'cause they like getting to hang out with an angry old man. He gives them his old uniforms while vicariously living out his anger at Trimet through them as they pretend they're Trimet Operators.

PERSONALLY AL,  I would think you'd be getting  a much larger support base if you kept 'IT' FOCUSED on THOSE ISSUES you claim near and dear instead of acting out through silly irrelevant revengeful acts of terrorism.  i.e. name calling, putting a dick on that guy's head or Trimet uniforms on the bodies of TWO groupies. (numbers subject to change). You might wanna re-examine your motives and the type of results you expect to get from blogging.   You know, one of those 'the end justifies the means' type of things.  

I'm gonna stick my nose in this because I find it totally in line with your online behaviors against me and am telling you this 'Uniform' thing is disrespectful.  Not just disrespectful but BIZARRO!!! When we see Lane and Alex wearing them it's like a slap in the face to every Operator. We're PROUD to wear them.  You chose differently,  that's your business. We're PROUD to be Union. We're PROUD to be part of the working class providing transit options to those who choose transit or are transit dependent.  

I asked Lane to PLEASE remove the logos, he said he would but didn't.  He doesn't understand. He only hears your rhetoric. Lane Jensen IS anti Trimet, anti-Bus Operator (always looking for fault), anti Union (even though he's never been in one) and doesn't understand what a respectable balance between thought and action looks like and THEN he's  confrontational to Supervisor Wayne!  He doesn't understand who we are and what we do. He's your creation! He's not someone who's capable of making judgments based on his own experiences AND he's Trimet dependent. Should he end up getting excluded that'll be on you! 

Al, ya need to step off the fence you've been dangling over for the last several years and make a decision.  If it's Union - then SUPPORT your Union family. If it isn't then find a life!!!

TRIMET RIDERS RECOGNIZE ME


The last couple of days I've had three Trimet customers approach me from video, image and name recognition which they got from the repetitive negative Blog postings (Cyber Bully/Stalking) of Al Margulies aka Rantings of a Trimet Bus Driver and Chris Day, True Union Values. These postings CONTINUE to be up and publicized even though I've objected repeatedly to Trimet.

Two came from riders who recognized me while I too, was riding.

The other came from a customer who was on a bus I was Operating. 

Slanderous information, videos and images continue to be posted even after my complaints which went all the way up and all the way down the chain of command including Neil McFarlane (who, btw doesn't respond to Operator issues) and ending with my Station manager and asst manager. Trimet refuses to respond and enforce their own policies with regard to these bullies who continue to attack me through the internet.  

My complaint to Carol Jolly, Lead HR Investigator resulted in, "HR policies are only enforceable while in your workplace. Your Bus is not your workplace," They don't even know what it is that we do for Trimet.

"TriMet employees are personally responsible for the content they publish on the Internet, both internally and externally. Internet communications and postings may not violate TriMet policy or procedure.  TriMet policies regarding Employee Conduct (HR 166) and Respectful Workplace (HR 171) also apply when you make Internet Postings regarding TriMet coworkers or customers."
